1. Application of Terms


These Website Terms & Conditions ("T&Cs") apply to your access and use of www.hyperresilience.com (the "Site"), including all software, data, reports, text, images, sounds, videos, and content made available through any portion of the Site (collectively, the "Content").


2. Acceptance of Terms


Infoallianz IT Solutions Private Limited, operating the HyperResilience.com platform ("HyperResilience™," "we," or "us"), permits you ("User," "you," or "your") to access and use the Site and Content, subject to these T&Cs. By accessing or using the Site or Content, you agree to be bound by these T&Cs. If you are using the Site on behalf of a company or other entity, you represent that you have the authority to bind such entity to these T&Cs.


3. Updates to T&Cs


HyperResilience reserves the right to modify these T&Cs at any time. Changes will be posted on the Site with the date of the latest revision. Continued use of the Site and Content constitutes acceptance of the updated T&Cs.


4. General Conditions / Access and Use


4.1 Authorization to Access and Use Site and Content


Subject to your compliance with these T&Cs, you may access and use the Site and Content solely for evaluating HyperResilience and its services.


4.2 Ownership and Restrictions


All rights, title, and interest in the Site and Content are owned by Infoallianz IT Solutions Private Limited. You agree not to:

  1. sublicense, sell, rent, lease, assign, or exploit the Site or Content;

  2. use the Site or Content unlawfully or in a way that disrupts its performance;

  3. access restricted portions or attempt to bypass security features;

  4. reproduce or redistribute any part of the Site except for limited personal use with all proprietary notices intact.

4.3 User Data Responsibility


You are responsible for all data and content you upload, post, or store in connection with the Site.


4.4 Reservation of Rights


Infoallianz IT Solutions Private Limited retains all intellectual property rights related to the Site and Content.


5. Use of Intellectual Property


5.1 Rights in User Content


By posting content on the Site, you grant Infoallianz IT Solutions Private Limited a worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with the Site.


5.2 Unsecured Transmission


You acknowledge the risk of unencrypted data transmission and are responsible for securing your own data.


5.3 Feedback


Any feedback you submit may be used by Infoallianz IT Solutions Private Limited without obligation or compensation.


6. Representations and Warranties


You represent that your use of the Site and your content does not infringe any third-party rights or violate any law.


7. Termination of Access


HyperResilience may terminate your access to the Site without notice for violating these T&Cs or applicable laws.


8. Copyright Infringement


If you believe that any content on this Site infringes your copyright under the Indian Copyright Act, 1957, you may send a written notice to legal@hyperresilience.com containing:​

 

  1. A description of the copyrighted work claimed to have been infringed;

  2. The exact location (URL) of the allegedly infringing material on our Site;

  3. Your name, address, telephone number, and email address;

  4. A statement that you have a good faith belief that the disputed use is not authorized by you, your agent, or the law;

  5. A statement, made under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner; and

  6. Your physical or electronic signature.


We will act on valid notices in accordance with applicable Indian laws.


9. No Warranties / Disclaimer


THE SITE AND CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. HYPERRESILIENCE DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE ACCESS.


10. Limitation of Liability


TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAWS OF INDIA, NEITHER INFOALLIANZ IT SOLUTIONS PRIVATE LIMITED NOR ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.


11. Jurisdiction and Dispute Resolution


These T&Cs are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.


12. No Reliance / Due Inquiry


The Site and Content are general in nature. You agree not to rely solely on them for making business decisions and to conduct your own due diligence.


13. Miscellaneous


These T&Cs constitute the full agreement between you and Infoallianz IT Solutions Private Limited regarding use of the Site. If any provision is deemed unenforceable, the remainder will remain in effect. Notices can be sent to legal@hyperresilience.com

By accessing this Site, you represent that you are not subject to sanctions or embargoes and are legally permitted to use this Site.
